Human Rights Violation: Our Legal Struggle Against Extension of Time in Removal Centers
Turkey’s Law on Foreigners and International Protection (LFIP), Law Number: 6458, sets certain limits on the time foreigners can be held under administrative detention in removal centers. According to the law, this period is a maximum of 6 months. However, if the deportation process cannot be completed due to non-cooperation or lack of correct information/documents from the foreigner, this period can be extended for another 6 months at most. However, there are many instances where this limit is breached, extending to 8 months or even 10 months.
Our legal struggle in this matter can be examined under two main headings: Legal Cases:
- Administrative Litigation: We apply to administrative courts to request the release of foreigners if the detention period exceeds the legal limits. We generally succeed in these types of cases, resulting in the release of the foreigners.
- Individual Application to the Constitutional Court: We make individual applications to the Constitutional Court, arguing that the extension of the period violates human rights. These types of applications aim to protect fundamental rights and freedoms.
Human Rights Violation Complaints:
- National Mechanisms: We file complaints with national mechanisms like the Human Rights and Equality Institution of Turkey.
- International Mechanisms: We also present our complaints to international institutions such as the European Court of Human Rights and the United Nations. These types of applications exert pressure for Turkey to fulfill its international obligations.

Farid’s Rebirth: From Asylum Rights to a New Life
