The damages arising from the tenant vacating the property before the end of the lease term and legal regulations related to rent law in Turkey

If the tenant vacates the property before the lease term ends, they are required to immediately pay the rent for the remaining months according to the rules stated in the contract. However, in this case, the tenant’s damages are limited to the rental amount for the period during which the property remained vacant until it could be leased again under the same conditions. In other words, the amount of damages is equal to the rental fee for the period of vacancy after the eviction date.
For example, Alex has a lease agreement to rent David’s apartment for 1 year. However, Alex decides to vacate the property at the end of the 6th month without paying the rent for the remaining 6 months.
In this case, according to the provision stated in the lease agreement, Alex is required to immediately pay the rent for the 6 remaining months that he didn’t fulfill. However, David’s damages are limited to the period during which the apartment remained vacant until it could be leased again under the same conditions.
Let’s assume that David was able to rent the apartment to another tenant under the same conditions after 2 months. In this scenario, the amount of damages Alex is required to pay is the rent for the 6th and 7th months. In other words, the damages incurred by David due to the apartment being vacant for the 2 months after Alex’s eviction date is equal to the rent for 2 months.
In this example, the amount of damages Alex needs to pay is limited to the rental amount for the period during which the apartment remained vacant, rather than the rent for the remaining months in the lease agreement.
